Terms of Service

Important

Please read my Terms of Service carefully, as it acts as a contract between Artist and Client for servicing a commission. By paying for a commission from me, you agree to all terms listed.- I reserve the right to decline any commission, for whatever reason.- My Art Commissions are Digital Goods only.- Commissions can be requested thru Google Forms only.- I retain my rights to the artwork. Do not claim the art as your own.- You retain your rights to your characters. I will not claim your characters as my own.- You may use and display the artwork non-commercially. (Example: You may use the art as an icon/banner, print it for personal use, etc. You may not mass print it for sale, including but not limited to, stickers, prints/posters, books.)- You may NOT use the artwork in any manner associated with blockchain technology, cryptocurrency trading, or mint the work as an NFT.- You may NOT use the artwork for any type of AI art dataset training. (This includes running a sketch or any WIPs [Works in Progress] through dataset training.) Note: Client shall not reproduce and/or otherwise use the Work in any manner for purposes of training artificial intelligence technologies to generate work, including without limitation, technologies that are capable of generating works in the same style or genre as the Work. Nor shall Client sublicense others to reproduce and/or otherwise use the Work in any manner for purposes of training artificial intelligence technologies to generate work.- I reserve the right to (or not) post the artwork commissioned to any of my social sites. I may also use the work to promote my art/commissions in the future.- I will not resell or re-use the artwork, although I may post the inital sketch as well as any and all WIPs to my Patreon and possibly show the work to future clients as an example of my work.- By commissioning me, you are commissioning a work of art in my style. If there is a specific style I have done in the past that you would like me to imitate, please let me know. I cannot guarantee that I can replicate it.- What I WILL draw: Humans, Humanoids, Personas, Depictions of You the Commissioner (non-persona/resembling You in Real Life/IRL), Friends/Partner(s)/Family of the Commissioner (IRL or Persona), Furries/Fursonas, Animals, OCs, Basic/Simple Mecha, Gore/Horror, Tasteful Nudity, Monsters- What I WILL NOT draw: NSFW, Real People (celebrities, content creators, etc.), Complex Mecha, Fetishes, anything that promotes hate speech such as racism, homophobia, transphobia, etc.If you are confused, ask!

Process

- You may place a request through the Google Forms sheet found at the bottom of this page. I will respond within 72 hours if your commission has been accepted or denied.- I require reference images before accepting. This includes an unshaded reference image of your character(s). The more references and details, the better! I do not accept AI generated content as reference.- I require information and details regarding the type of commission such as posing, expression, and colors. Stock images or even an MS paint doodle/stick figure helps a ton and can make the process much smoother!- All payment is via Stripe in USD. You do not need an account to use this site, and it is as if you are paying for any other product online. NOTE: If payment is not received within a week of invoice being sent, the commission will be cancelled and your slot will be reopened or given to someone else.- If accepted, I will send you payment information via DMs or email. Full payment is required up front. Your commission will not be started before full payment has been completed.
I do not currently do payment plans.- I am not responsible for any mistakes that are made on your part over the course of the transaction.- Once payment is complete, I will begin on an initial sketch. This may take up to a week to complete and send.- When a WIP is sent, I need your explicit confirmation that everything is good in order to proceed.- Unless otherwise agreed, your order will be completed within three months of the initial sketch. Note that I may complete the commission well before this end date.- Let me know if you have a specific deadline for the ordered commission, as it may require a rush fee. ($10-$30 depending on complexity of the commission.)- I do not do private commissions, but if asked I may delay posting until a certain date if the artwork is intended to be a gift or revealed publicly later.

Extra Fees

- Complex or heavily detailed backgrounds start at $10, but may increase depending on the exact type.- Design Commissions fees start at $5, but may increase to $15 based on complexity of design.- Each extra character is 50% of base price.- During the sketching and WIPs phase, any changes or adjustments are free of charge. If a large change is requested after I complete the commission (for example, changing an entire outfit/pose), a fee of up to $10 may be charged based on complexity of the change.- Refer to the chart below for usage rights and pricing.

Refunds and Cancellation

- You are allowed to request a refund at any time, however the percent (%) of the refund depends on the progress I have already made on your commission.
You can check the process stage on my to-do list at any time.- By commissioning me you forfeit your right to receive a refund depending on the level of completion of it as explained above. Once work on the commission is started, you are not going to receive a full refund unless below situations apply.- If there is no color label or process amount on your order name on the to-do list, that entitles you to a 90% refund at any time.- You are entitled to 100% refund if I miss the set deadline without explanation and mutual agreement to move said deadline forward. You are also entitled to 100% refund if it comes from the artist’s initiative (cancelling the order for whatever reason).- The refund amount does not cover any payment processor fees.- After receiving a refund you will NOT receive the file of the piece I have been working on so far.- If you file an unjust chargeback against me, your license to every artwork I have ever made for you (adoptables, character designs, any obtained licenses to use of my artwork) will be retracted (non-refundable) and I have the right to sell the copyrighted artwork (as YCH) or design to new buyers.
You will be blacklisted from commissioning me ever again.
Your username may be publicly posted in order to warn others.
I also have every right to file a complaint and I have all the right to the money you have given me.
